Questions Carriers Ask

What does the FMCSA emergency rule on non-domiciled CDLs require?

State licensing agencies can no longer issue or renew a non-domiciled CDL or CLP unless the driver holds an H-2A, H-2B, or E-2 visa. States must also verify immigration status through the DHS SAVE system and limit license validity, and the rule went live the same day it dropped, with no comment period.

I use foreign drivers on other visa types. What now?

If your drivers are not on one of the three qualifying visas, the post is direct that you have a problem on your hands right now. Identify affected drivers immediately, check each license status and expiration, and plan for renewals that will not be granted under the new criteria.

Why did FMCSA move without a comment period?

The post covers why FMCSA pulled the trigger on an emergency basis and the numbers behind the decision. The message is that non-domiciled licensing has become a priority enforcement target, and carriers should expect continued tightening rather than a rollback.
